Purchasing real estate in Spain is one of the most rewarding lifestyle and financial decisions for international investors. However, navigating Spain's distinctive legal and fiscal framework requires clear clarity from the outset. Here is your definitive roadmap to purchasing with total security.

1. THE ESSENTIAL FIRST STEP: OBTAINING A NIE

To execute any legal or financial transaction in Spain—from signing purchase contracts to paying taxes or registering deeds—you require a NIE (Foreigner Identity Number).

  • How to apply: Through Spanish consulates in your home country or directly via the National Police in Spain with an appointment.
  • Spanish Bank Account: Facilitates seamless payment of utility bills, taxes, and completion funds.

2. PURCHASE TAXES AND CLOSING COSTS

Buyers should budget approximately 10% to 14% on top of the agreed purchase price for taxes and legal fees:

  • Resale Properties: Property Transfer Tax (ITP), currently fixed at a competitive flat 7% in Andalusia.
  • New Build Properties: 10% VAT (IVA) plus 1.2% Stamp Duty (AJD) in Andalusia.
  • Closing Costs: Notary fees, Land Registry inscription fees, and independent legal representation.

3. DUE DILIGENCE: VERIFYING THE PROPERTY

  • Nota Simple: Official Land Registry extract verifying current registered ownership, absence of mortgages, liens, or court embargoes.
  • Urbanistic Compliance: Confirmation that the property holds valid municipal occupation licenses and is debt-free with the community of owners.
